Burn Ban Issued in Henderson County & NC

March 21, 2025:

Due to increased fire risk and fires burning in the region, both the N.C. Forest Service and Henderson County have issued a ban on all open burning and has canceled all burning permits statewide effective 8 a.m. Friday, March 21 until further notice.

  • North Carolina: Under North Carolina law, the ban prohibits all open burning, regardless of whether a permit was previously issued. The issuance of any new permits has also been suspended until the ban is lifted. Anyone violating the burn ban faces a $100 fine plus $183 court costs. Any person responsible for setting a fire may be liable for any expenses related to extinguishing the fire. The state burn ban does not apply to fires started within 100 feet of an occupied dwelling. The local fire marshal has authority to issue a burn ban within that 100 feet.
  • Henderson County: Under authority of the Henderson County Code, Section 78-16.1 all outdoor burning is prohibited in areas within 100 feet of a structure. The Henderson County burning ban shall remain in effect until conditions improve and the ban is cancelled.
  • City of Hendersonville: Open burning is always prohibited in the City of Hendersonville. The burn ban also prohibits any recreational use of fire pits that are typically allowed in the city. The issuance of the burn ban includes the prohibition of using any recreational fire pits that are typically allowed within the city limits.
